Terms and Conditions

These Terms and Conditions govern the specific rules and obligations that apply to your engagement with iTanah's buyer representation services. They supplement and should be read together with our Terms of Service and Privacy Policy. By using the iTanah platform you agree to these Terms and Conditions in full.
1. Introduction
iTanah Sdn. Bhd. ("iTanah") provides a technology-enabled buyer representation service for property transactions in Malaysia. These Terms and Conditions set out the specific rules, rights, and obligations that govern your use of the platform and participation in any deal facilitated through it.
2. Use of Service
Access to the platform is granted on a role-specific basis. Your permitted actions within the platform are determined by the role assigned to your account (Client, Platform Advisor, Lawyer, External Agent, or Seller). You agree to use the platform only for its intended purpose and in accordance with the permissions associated with your assigned role.
Any action taken on the platform — including approving a deal stage or confirming a transaction — constitutes a valid electronic record under the Electronic Commerce Act 2006 (Malaysia) and is legally binding to the extent provided by applicable law.
3. User Responsibilities
You agree to:
- Provide accurate, current, and complete information during registration and KYC verification.
- Promptly notify iTanah of any changes to your personal or professional details.
- Review all documents presented to you carefully before approving.
- Maintain the confidentiality of sensitive deal information shared with you through the platform.
- Comply with all conditions attached to your assigned role, including professional licensing obligations applicable to lawyers and property agents.
4. Platform Fees
Use of certain platform features is subject to fees as communicated to you at the time of registration or plan selection. All fees are quoted in Malaysian Ringgit (MYR). iTanah reserves the right to introduce, adjust, or revise platform fees at any time. Where such changes affect your active plan or ongoing engagement, you will receive at least thirty (30) days' advance notice before the new rates take effect. Your continued use of the platform after the notice period constitutes acceptance of the revised fees.
In addition to platform fees, iTanah may earn commission or profit-sharing arrangements in connection with transactions facilitated through the platform. Any such arrangements will be disclosed in the relevant deal documentation prior to your agreement.
5. Intellectual Property
All content, software, design elements, logos, trademarks, and materials made available through the iTanah platform are the exclusive property of iTanah Sdn. Bhd. or its licensors. Nothing in these Terms grants you any licence or right to use, copy, reproduce, or create derivative works from any iTanah intellectual property without our prior written consent.
Documents you upload to the platform remain your property. By uploading, you grant iTanah a limited, non-exclusive licence to store and process those documents solely for the purpose of providing the platform services.
6. Limitation of Liability
To the fullest extent permitted by Malaysian law, iTanah shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including loss of profits, loss of data, or failure of a property transaction to complete.
iTanah's total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total fees paid by you to iTanah in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.
7. Confidentiality
All information shared through the platform relating to a deal, including property details, financial information, and counterparty identities, is confidential. You agree not to disclose any such information to third parties without the prior written consent of iTanah and the relevant deal parties, except where required by law or a competent regulatory authority.
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia, save where the parties have agreed to arbitration as provided in the Terms of Service.
9. Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, that provision shall be deemed severed and the remaining provisions shall continue in full force and effect.
10. Entire Agreement
These Terms and Conditions, together with our Terms of Service and Privacy Policy, constitute the entire agreement between you and iTanah with respect to your use of the platform and supersede all prior agreements, representations, and understandings relating to the same subject matter.
