Terms of Service

1. Acceptance of Terms

By registering for an account or using any part of the iTanah platform, you confirm that you are at least eighteen (18) years of age, have the legal capacity to enter into a binding agreement, and agree to comply with these Terms and all applicable Malaysian laws and regulations.

2. Service Description

iTanah is a professional buyer representation platform for property transactions in Malaysia. The platform facilitates the engagement between buyers, platform advisors, legal counsel, and property agents. Our services include deal pipeline management, Know Your Customer (KYC) verification, document management, and communication tools.

iTanah acts as an intermediary and platform operator. We do not hold a real estate agency licence and do not act as a registered estate agent within the meaning of the Valuers, Appraisers, Estate Agents and Property Managers Act 1981. Transactions are facilitated through licensed external agents where required.

3. User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@itanah.com if you suspect any unauthorised access. We reserve the right to suspend accounts that show signs of compromise or misuse.

Each account is personal and non-transferable. You may not share your account credentials with any third party.

4. Privacy and Data Protection

Your use of the platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to the collection and processing of your personal data as described therein, in accordance with the Personal Data Protection Act 2010 (Malaysia).

5. Platform Fees and Payment Terms

iTanah charges platform fees for access to its services. These may take the form of a subscription fee, a one-time access fee, or a transaction-based fee, depending on the plan or service engaged. All fees are quoted in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless otherwise stated. Payments are non-refundable except where required by law or as expressly stated in a specific plan.

iTanah may also earn commission and profit-sharing fees in connection with completed property transactions facilitated through the platform. The applicable fee structure will be disclosed in the relevant deal documentation and agreed by the parties prior to execution.

Fee Changes: iTanah reserves the right to revise its platform fees at any time. Where a fee change affects existing active subscribers or ongoing engagements, we will provide at least thirty (30) days' advance notice via email or platform notification before the new rates take effect. Continued use of the platform after the notice period constitutes acceptance of the revised fees. If you do not accept the revised fees, you may terminate your account before the effective date without penalty.

6. Prohibited Activities

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable law.
• Submit false, misleading, or fraudulent information including during KYC verification.
• Attempt to gain unauthorised access to any part of the platform or its infrastructure.
• Interfere with or disrupt the integrity or performance of the platform.
• Use the platform to facilitate money laundering, tax evasion, or any activity that violates the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.
• Reverse engineer, copy, or create derivative works of any part of the platform.

7. Termination

You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate your access with or without notice if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent conduct, or if required by law or regulatory directive.

Upon termination, your right to access the platform ceases immediately. Provisions that by their nature should survive termination (including payment obligations, confidentiality, and limitation of liability) will continue to apply.

8. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses. We make no warranty as to the accuracy or completeness of any property information displayed on the platform.

9. Dispute Resolution

In the event of a dispute arising from or related to these Terms or your use of the platform, the parties agree to first attempt to resolve the matter through good-faith negotiation. If unresolved within thirty (30) days, the dispute shall be referred to arbitration in Kuala Lumpur under the rules of the Asian International Arbitration Centre (AIAC), unless both parties agree otherwise in writing.

10. Changes to Terms

We may revise these Terms from time to time. We will provide at least fourteen (14) days' notice of material changes via email or platform notification. Continued use of the platform after the effective date of changes constitutes your acceptance of the revised Terms.
